This Seller Agreement (this "Agreement") is between you (the "Seller") and TT Poke (the "Platform", "we", "us"), and applies in addition to our Terms of Use and Privacy Policy. It governs how you list and sell trading cards and other collectibles ("Items") through the TT Poke marketplace. By ticking "I agree" you accept this Agreement and confirm you are authorised to sell the Items you list. TT Poke operates only as a third-party intermediary, similar to a Hong Kong consignment shop (格仔舖): we provide the venue and handle payment as your agent — we are not the buyer, the seller, or the owner of your Items.
TT Poke is a venue and disclosed agent that lets members list and sell their own Items to other members. Each sale is a contract between the Seller and the buyer; TT Poke is not a party to that contract and never takes ownership of, or title to, any Item. Our role is limited to listing, facilitating communication, collecting payment as the Seller’s agent, holding it briefly in escrow for buyer protection, and remitting the proceeds to the Seller. We do not guarantee that any Item will sell.
You are the principal and seller of record for every Item you list. You are solely responsible for the Item and for the accuracy and legality of your listing, including its description, condition, grading, authenticity, photographs, price, and any applicable taxes. Your listing must show true photographs of the actual Item and be kept up to date; you must promptly remove or mark Items that are no longer available.
When a buyer purchases your Item, the buyer’s payment is received by TT Poke as your collection agent and held briefly in escrow on your behalf, kept separate from our own funds. We release the proceeds to you after the buyer confirms receipt, or after the buyer-confirmation window lapses with no dispute. Funds held are not deposits, are not investments, bear no interest, and are not pooled or used for our own account; we hold them only transiently and remit them to you without any long holding period. At payout we deduct our commission and any amounts you owe us.
Payouts and refunds are made only to a Hong Kong FPS or Hong Kong bank account, and the service is offered to Hong Kong-based users; we do not provide cross-border money transfer. By default, we pay your sale proceeds by FPS to the mobile number registered to your TT Poke account. If you want to be paid to a different account, or the number registered to your account is not enabled for FPS, you must contact us to confirm your payout details before you list an item. You are responsible for keeping your registered phone number and payout details accurate and up to date. To the fullest extent permitted by law, TT Poke is not responsible for, and does not bear the cost of, any mis-transfer, delay, or loss that results from payout details you did not clarify with us before listing.
Items sold on the Platform are physical collectibles, not securities, futures, or any financial product, and nothing on the Platform is investment advice or an offer of any investment or collective investment scheme. We do not pool members’ money for investment, do not operate any buy-back or price guarantee, and do not promise any resale value or return. You must not market any Item as an investment or promise buyers any financial return.
Your sale proceeds are your own money. When your Item sells, the buyer's payment is collected by us as your disclosed collection agent and held briefly on your behalf; after the buyer confirms receipt, or after the buyer-confirmation window lapses with no dispute, we remit it to your Hong Kong FPS or bank account, less our commission and any amount you owe us. We do not keep any balance for you on the Platform — each payout is a one-off remittance for a specific completed sale. Such funds are not held with us as a deposit or account, are not a balance you can spend, transfer, or withdraw within the Platform, bear no interest, and are never pooled or used for our own account.
You confirm that you lawfully own or are authorised to sell each Item, and that neither your Items nor your funds derive from any unlawful activity. We may verify your identity and payout account, request information, and — where we reasonably suspect fraud, money laundering, sanctions issues, or other unlawful conduct — withhold or freeze a payout, decline or reverse a transaction, and make any report required by law.
You may list only genuine Items. Counterfeit, replica, stolen, or infringing Items are strictly prohibited. You indemnify TT Poke against any claim arising from your Items or listings. We operate a notice-and-takedown process, may remove listings and cooperate with rights holders and Customs, and may terminate sellers who repeatedly infringe.
After your Item is delivered, the buyer has a confirmation window of 5 days. If the buyer confirms receipt, or the window lapses with no dispute, the sale is treated as completed and your proceeds become payable. Our decision to release funds to you or refund the buyer is an administrative payment decision for the escrow only, and is not a legal adjudication of the parties’ rights.
Once an order is placed you must ship the exact Item listed within 3 business days, using a tracked method, and upload the tracking number to the Platform. If you cannot fulfil an order you must cancel it on the Platform before the shipping deadline so the buyer is refunded promptly. To list, you authorise a refundable HK$100 security deposit, which is not a loan, bears no interest, and is returned when you leave the Platform in good standing with no open orders, disputes, or amounts owing. If you fail to ship a sold Item on time, or ship something materially different from the listing, without a reason we accept as valid, a charge of HK$100 per affected Item applies as liquidated damages — a genuine pre-estimate of the buyer’s inconvenience and our administrative cost — which we may take from your deposit and/or deduct from your proceeds, and we will refund the buyer in full. This charge is not a cap on your liability and does not entitle you to fail to ship; repeated non-shipment may lead to suspension or termination. We strongly recommend you ship from an SF Express store (not an SF locker) and film a continuous video of the SF staff packing the Item — showing it safely wrapped and placed into a protective case before it is sealed — and keep that video. If improper or unsafe packing or shipping by you causes damage to a card in transit, you are responsible and must bear the loss and compensate the buyer; a seller who cannot provide reasonable proof of proper packing and shipping is highly likely to bear the loss in a dispute. You will cooperate with our dispute process and respond within the time we specify. Where a dispute is upheld (for example, an Item not received or not as described), you authorise us to refund the buyer in whole or part from the held funds and/or arrange a return at your cost, and we may set off amounts you owe against your deposit or proceeds. You remain responsible for any shortfall and for losses arising from your inaccurate listing, late or non-shipment, or breach of this Agreement. When a dispute is raised, both the seller and the buyer should provide legitimate evidence (e.g. the seller’s packing/shipping video and the buyer’s continuous unboxing video). The Platform will weigh the evidence and decide the outcome in its reasonable discretion; the side that cannot provide the required evidence is highly likely to bear the loss and to make compensation. The Platform has the ultimate right to decide whether or not to refund either side, bears no responsibility for any accident or loss in transit, but will use its best efforts to protect both sides fairly. We retain a commission of 3% of the sale price on each completed transaction, deducted from your proceeds at payout, together with any amounts you owe us. We may introduce or adjust fees on reasonable notice; the fees applicable to a listing are those disclosed at the time you list.
You will not divert buyers off-platform to avoid fees or buyer protection, or to complete a sale begun on the Platform elsewhere. Doing so is a breach of this Agreement.
You confirm that you are at least 18 years old, have legal capacity, own or are authorised to sell each listed Item, and that your listings and conduct comply with this Agreement, our Terms of Use, and the laws of Hong Kong.
Title to and risk in an Item pass directly from the Seller to the buyer in accordance with the sale between them; TT Poke never takes title to, or assumes risk in, any Item. You are responsible for packing each Item appropriately for transit.
To the fullest extent permitted by law, TT Poke is not liable for the Items, for the conduct of buyers or sellers, or for any indirect or consequential loss, and our aggregate liability is limited to the commission we received on the relevant transaction. You indemnify us against claims arising from your Items, listings, or breach of this Agreement. Nothing in this Agreement excludes or limits any liability that cannot lawfully be excluded or limited.
We may suspend or terminate your selling access for breach, suspected fraud, or legal reasons, and may withhold a payout pending investigation. You may stop selling at any time; this Agreement continues to apply to transactions already begun.
We collect and use your personal data — including your phone number, payout-account name, address, and device information — to operate the marketplace, verify identity, process payouts, and meet our legal obligations, as described in our Privacy Policy. By accepting this Agreement you consent to that use.
If we cannot remit your proceeds or return your deposit because you are unreachable or your payout account is invalid, we will hold the funds for you and use reasonable efforts to contact you. Such funds remain your property and are never converted into Platform revenue.
When you accept this Agreement we record your account, the agreement version, the date and time, and your IP address and device, as evidence of your acceptance.
If any provision is held invalid, the remaining provisions continue in effect. We may amend this Agreement at any time; material changes take effect on publication on the TT Poke website, and your continued use after that constitutes acceptance. This Agreement is the entire agreement between us on its subject matter; our failure to enforce a term is not a waiver; you may not assign your rights without our consent; and, except as stated, no third party has any right to enforce this Agreement.
This Agreement is governed by the laws of Hong Kong, and the parties submit to the exclusive jurisdiction of the Hong Kong courts. In the event of any discrepancy between the Chinese and English versions of this Agreement, the Chinese version shall prevail.
